[ACTIVE] Public Hearing Notice

Notice is hereby given that the Bismarck Planning & Zoning Commission will hold public hearings on Wednesday, December 19, 2012, at 5:00 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:

• Request of LB Family Properties, LLC for approval of a final plat for Expressway Terrace Addition, a one lot subdivision on 2.08 acres. The property is located along the north side of East Bismarck Expressway approximately 1/8 mile east of South 12th Street (all of Auditor’s Lot 4 of the SW 1/4 of Section 3, T138N-R80W/Lincoln Township).

• Request of Alvin Leingang and General Equipment & Supplies, Inc. for approval of a minor subdivision final plat for Expressway Industrial Park First Replat, a six lot subdivision on 14.65 acres. The property is located along the west side of Yegen Road south of Apple Creek Road (a replat of Lots 1-6 and 7A of Lot 7, Block 1, Expressway Industrial Park and Lot 3B of Lot 3, Block 2, Missouri Valley Complex 1st Replat).

• Request of Steve and Michelle Mariner for approval of a final plat for Pine Meadows Third Addition, a one lot subdivision on 2.00 acres. The property is located east of Bismarck, south of County Highway 10 and east of 80th Street SE (all of Auditor’s Lot A of the SE 1/4 of the NW 1/4 of Section 4, T138N-R79W/Apple Creek Township).

• Request of Steve and Michelle Mariner for approval of a zoning change from the A – Agricultural zoning district to the RR – Residential zoning district for Apple Creek Ridge Subdivision. The property is located east of Bismarck, south of County Highway 10 and west of 119th Street NE (Auditor’s Lot 5 and Auditor’s Lot X of Auditor’s Lot 5 of the E 1/2 of Section 35 and Auditor’s Lots 6 and 7 and Auditor’s Lot Y of Auditor’s Lot 7 of the SE 1/4 and the NE 1/4 of Section 35, T139N-R79W/Gibbs Township).

• Request of Steve and Michelle Mariner for approval of a final plat for Apple Creek Ridge Subdivision, a 56 lot subdivision on 119.2 acres. The property is located east of Bismarck, south of County Highway 10 and west of 119th Street NE (Auditor’s Lot 5 and Auditor’s Lot X of Auditor’s Lot 5 of the E 1/2 of Section 35 and Auditor’s Lots 6 and 7 and Auditor’s Lot Y of Auditor’s Lot 7 of the SE 1/4 and the NE 1/4 of Section 35, T139N-R79W/Gibbs Township).

• Request of Tiemac Inc. for approval of a zoning change from the RT – Residential zoning district to the RMH – Residential zoning district for Lot 7, Block 2, Capital Electric Headquarters Addition. The property is located south of 43rd Avenue NE between US Highway 83 and North 19th Street.

• Request of Jomani Developing, LLC/Felton Developing for approval of a zoning change from the RM15 – Residential zoning district to the RM30 – Residential zoning district for Lots 1-3, Block 1 and Lots 1-4, Block 3, Sonnet Heights Subdivision. The property is located along the north side of Niagara Drive, south of 57th Avenue NE, approximately 1/4 mile west of US Highway 83.

• Request of Skyline Properties, LLC for a special use permit for a drive-through to be located on Lot 5, Block 1, Meadowlark Commercial 4th Addition and the West 118 feet of Lot 3, Block 1, Meadowlark Commercial 5th Addition Replat. The property is located along the south side of Skyline Drive, between US Highway 83 and North 19th Street (building being constructed at 1401 Skyline Boulevard).

• Request of the City of Bismarck for a zoning ordinance text amendment relating to neighborhood recreation and open space. The proposed amendment would establish requirements for the dedication of neighborhood recreation and open space or payment in lieu of dedication, in conjunction with the platting and annexation process.

• Request of the City of Bismarck for a zoning ordinance text amendment relating to the utility use group. The proposed amendment would modify the requirements for utility buildings and structures in all zoning districts.

At these hearings, the Bismarck Planning & Zoning Commission will provide an opportunity for all interested persons to be heard with respect to these items. Interested persons may also submit written comments regarding these requests prior to the meeting to the Community Development Department, PO Box 5503, Bismarck, North Dakota 58506-5503, fax: 701-222-6450, or e-mail - cobplan@nd.gov. Interested persons may also call 701-355-1840 with questions or for additional information.

Descriptions of these requests are on file and may be viewed or copied any working day between 8:00 a.m. and 5:00 p.m. at the City-County Community Development Department, 221 North 5th Street, Bismarck, North Dakota.
